Welcome to Oregon Pest Control. These Terms of Service govern your access to and use of our pest control services, website, and related offerings. By scheduling service, requesting a quote, or using our digital platforms, you agree to these terms in full. If you do not agree with any provision, please discontinue use of our services immediately.
Service Description
Oregon Pest Control provides residential, commercial, and industrial pest management services throughout the State of Oregon. Our services include, but are not limited to, inspection and identification of pest activity, implementation of integrated pest management strategies, application of EPA-registered pesticides and alternative treatment methods, exclusion work, ongoing monitoring programs, and consultation on pest prevention practices. Specific treatment protocols are determined based on property conditions, pest species identified, environmental factors, and applicable regulatory requirements.
Service appointments are scheduled during normal business hours, Monday through Saturday, with emergency services available in designated areas for additional fees. All service personnel are licensed by the Oregon Department of Agriculture and follow label instructions and state regulations for all products applied. Treatment effectiveness depends on numerous variables including pest species, infestation severity, structural conditions, weather, and customer cooperation with preparation and post-treatment instructions.
No Guarantee or Warranty
Oregon Pest Control does not guarantee complete elimination of all pest activity from any treated property. Pest biology, environmental conditions, neighboring infestations, and other factors beyond our reasonable control may result in continued or renewed pest presence following treatment. Our service warranties, where offered, are limited to specific treatment programs and timeframes as explicitly set forth in individual service agreements. Any warranty is contingent upon customer compliance with all preparation requirements, access provisions, and follow-up recommendations.
We make no representations regarding the permanent prevention of future infestations. New pest introductions from adjacent properties, travel, commerce, or natural migration may occur independently of our services. Organic, natural, or reduced-toxicity treatment options may require more frequent applications and may achieve different results than conventional methods. Customer acknowledges that pest management is an ongoing process rather than a single event.
User Responsibilities
Customers must provide accurate information about property conditions, pest observations, prior treatments, chemical sensitivities, and presence of children, pets, or vulnerable individuals. Failure to disclose material information may compromise treatment safety and effectiveness. Customers are responsible for preparing properties according to provided instructions, which may include removing food items, securing pets, clearing access to treatment areas, and vacating premises for specified periods.
Post-treatment, customers must follow all written and verbal instructions regarding ventilation, cleaning restrictions, reoccupancy timing, and monitoring for pest activity. Customers must maintain structural integrity through proper sealing, moisture control, sanitation practices, and landscape management to support treatment effectiveness. Unauthorized reapplication of pesticides or interference with treatment barriers voids all warranties and may create hazardous conditions for which Oregon Pest Control assumes no responsibility.
Limitation of Liability
To the maximum extent permitted by Oregon law, Oregon Pest Control's total liability for any claim arising from our services shall not exceed the amount actually paid by customer for the specific service giving rise to the claim. We shall not be liable for indirect, incidental, consequential, special, or punitive damages, including but not limited to property damage, loss of use, business interruption, personal injury, or emotional distress, regardless of whether such damages were foreseeable or whether we were advised of the possibility thereof.
We are not liable for damage to personal property, landscaping, or structures resulting from concealed conditions, pre-existing deficiencies, or customer failure to follow instructions. Our liability for pesticide application is limited to compliance with product labels and applicable regulations. Customers with health conditions, chemical sensitivities, or concerns about pesticide exposure should consult qualified medical professionals and inform Oregon Pest Control in writing prior to any treatment.
Intellectual Property
All content on Oregon Pest Control's website, marketing materials, service documentation, custom treatment plans, and proprietary methodologies are the exclusive intellectual property of Oregon Pest Control or its licensors. Customers receive no license to reproduce, distribute, modify, create derivative works from, or commercially exploit any materials without express written authorization. Trademarks, service marks, logos, and trade dress displayed on our platforms may not be used without prior written consent.
Customer-submitted photographs, testimonials, or feedback may be used by Oregon Pest Control for marketing purposes unless customer explicitly opts out in writing. We respect commercial confidentiality and will not disclose proprietary customer information to competing pest control providers.
Governing Law
These Terms of Service and any dispute arising hereunder shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to conflict of law principles. Any legal action shall be brought exclusively in the state or federal courts located in Multnomah County, Oregon. Customer consents to personal jurisdiction and venue in such courts. The prevailing party in any litigation shall be entitled to recover reasonable attorneys' fees and costs.
These terms operate subject to applicable Oregon Department of Agriculture regulations, Oregon Revised Statutes Chapter 634 governing structural pest control, and federal pesticide laws. In the event of conflict between these terms and mandatory applicable law, such law shall prevail.
Changes to Terms
Oregon Pest Control reserves the right to modify these Terms of Service at any time. Material changes will be communicated through our website, email notification to active customers, or inclusion with service documentation. Continued use of our services following any modification constitutes acceptance of the revised terms. Customers are encouraged to review these terms periodically. The effective date at the top of this document indicates the most recent revision.
